Terms of sale

1. Seller

The products offered on the Site are sold by SAPIR, a simplified joint-stock company with a share capital of 1,000 euros, 34 rue de Montmorency, 75003 Paris, France, Paris Trade and Companies Register 832 992 481, intra-community VAT number FR17832992481.
Showroom (by appointment): 18 Passage Molière, 75003 Paris.
Contact: contact@sapir.fr – +33 6 13 99 24 77.

2. Purpose and scope

These terms of sale (the “Terms of Sale”) apply to any sale concluded on the Site between SAPIR and a buyer (the “Buyer”) aged at least 18. They are available on the Site at all times; the Buyer accepts them when confirming the order. The applicable Terms of Sale are those in force on the date of the order.

Definitions. Product: a jewel, watch or piece of jewelry offered for sale on the Site. Order: the purchase of one or more Products on the Site.

3. Products

The Products are pre-owned jewels: antique, vintage or collectible. Each one is unique and is presented with a description and several photographs. The description sets out the essential characteristics of the Product and mentions any visible signs of wear or restoration. The photographs are as faithful as possible; colours may vary slightly depending on the screen.

4. Prices

Prices are stated in euros, including all taxes, excluding delivery costs. Delivery costs are shown before the Order is confirmed.

Price on request. For some Products, the price is not displayed and is given on request, via the form on the Site, by e-mail or by telephone. SAPIR then sends a written offer setting out the price, delivery costs and payment terms; the sale is concluded upon acceptance of this offer and payment, under these Terms of Sale.

5. Orders

The Buyer selects the Product(s), adds them to the basket, then confirms the Order and proceeds to payment. Before payment, the Buyer can check the details and the total price of the Order and correct any errors.
The Order is final once payment has been accepted. SAPIR acknowledges receipt by e-mail; the invoice is sent by e-mail.
SAPIR may refuse or cancel an Order for a legitimate reason, in particular in the event of suspected fraud or of a dispute with the Buyer over a previous Order.

6. Payment

Payment is made online using the methods offered on the checkout page (bank cards and other methods displayed), or by bank transfer for sales made on a written offer. Online payments are secured by the payment provider; SAPIR does not have access to the Buyer's bank details.

7. Delivery

Products are delivered to the address given by the Buyer, by Colissimo, FedEx or Malca-Amit. Shipments are always insured and delivered against signature. A tracking number is provided upon shipment.
SAPIR ships Products within 1 to 5 working days of payment confirmation, excluding resizing and engraving requests, for which a lead time is agreed with the Buyer. In any event, delivery takes place no later than 30 days after the Order.
The risk of loss or damage passes to the Buyer upon delivery of the Product. In the event of loss or theft during transport, SAPIR refunds or replaces the Order.
For deliveries outside the European Union, customs duties and local taxes are payable by the Buyer.
The Buyer is invited to check the parcel upon receipt and to report any anomaly to the carrier and to SAPIR.

8. Right of withdrawal

A Buyer who is a consumer has 14 days from receipt of the Product to withdraw from the purchase, without giving any reason.
The 14-day right of withdrawal applies to purchases made at a distance, on the Site, by telephone or by e-mail, including when the jewel is collected from the showroom. It does not apply to purchases concluded and paid for in the showroom.
How to withdraw. The Buyer informs SAPIR of the decision, before the period expires, by an unambiguous statement sent to contact@sapir.fr or by post, or using the withdrawal form below.
Returning the Product. The Buyer returns the Product no later than 14 days after communicating the decision, to: SAPIR, 18 Passage Molière, 75003 Paris, France. Return costs are borne by the Buyer; an insured shipment, for the value of the Product, is strongly recommended.
Refund. SAPIR refunds all sums paid, including the initial delivery costs (at the standard delivery rate), no later than 14 days after being informed of the decision to withdraw. SAPIR may withhold the refund until it has received the Product or proof of its return shipment. The refund is made using the payment method used for the Order.
Condition of the Product. The Buyer may examine and try on the Product as in a shop. The Buyer is only liable for any diminished value resulting from other handling; the amount of such diminished value may then be deducted from the refund. The Product must be returned with the documents that accompanied it (certificate, appraisal, case where applicable).
Exception. The right of withdrawal does not apply to Products resized, engraved, altered or personalised at the Buyer's request (article L221-28 of the French Consumer Code).

9. Legal guarantees

Products are covered by the legal guarantee of conformity (articles L217-1 et seq. of the French Consumer Code) and the legal guarantee against hidden defects (articles 1641 et seq. of the French Civil Code). These guarantees apply independently of any commercial guarantee. To invoke them, the Buyer contacts SAPIR at contact@sapir.fr.

The consumer has two years from delivery of the goods to invoke the legal guarantee of conformity if a lack of conformity appears. As the goods are second-hand, for twelve months from delivery the consumer only needs to establish the existence of the lack of conformity, not the date on which it appeared.

The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of the request, free of charge and without major inconvenience.

If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.

If the consumer requests repair but the seller imposes replacement, the legal guarantee of conformity is renewed for two years from the date of replacement.

The consumer may obtain a price reduction while keeping the goods, or terminate the contract and obtain a full refund upon return of the goods, if: (1) the seller refuses to repair or replace the goods; (2) repair or replacement takes place after thirty days; (3) repair or replacement causes the consumer major inconvenience; (4) the lack of conformity persists despite the seller's unsuccessful attempt to remedy it.

The consumer is also entitled to a price reduction or to termination of the contract where the lack of conformity is so serious that it justifies immediate price reduction or termination, without first requesting repair or replacement. The consumer is not entitled to terminate the sale if the lack of conformity is minor.

Any period during which the goods are immobilised for repair or replacement suspends the remaining guarantee period until the goods are returned in working order.

These rights result from articles L. 217-1 to L. 217-32 of the French Consumer Code. A seller who obstructs the legal guarantee of conformity in bad faith is liable to a civil fine of up to 300,000 euros, which may be increased to 10% of average annual turnover (article L. 241-5 of the French Consumer Code).

The consumer also benefits from the legal guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund upon return of the goods.

Normal wear inherent to an antique or vintage jewel, where it is described in the Product listing, does not constitute a lack of conformity. Damage caused after delivery by impact, a fall, misuse or lack of care is not covered by the legal guarantees.

10. SAPIR's commitment (commercial guarantee)

In addition to the legal guarantees, SAPIR repairs free of charge, for one year from delivery, any setting or clasp defect existing at the time of delivery, excluding damage caused by an accident, incorrect handling, a corrosive product or failure to follow care advice.

11. Personal data

The data collected when placing an Order is necessary to process it and for invoicing. It is processed in accordance with the Privacy policy.

12. Complaints and mediation

Any complaint should be sent to SAPIR at contact@sapir.fr or by post to 34 rue de Montmorency, 75003 Paris, France. SAPIR undertakes to seek an amicable solution with the Buyer.
Failing agreement, a Buyer who is a consumer may refer the matter free of charge to the consumer mediator to which SAPIR belongs: CM2C (Centre de la médiation de la consommation de conciliateurs de justice), www.cm2c.net.

13. Governing law and disputes

These Terms of Sale are governed by French law. In the event of a dispute, and failing an amicable solution, the French courts have jurisdiction; a Buyer who is a consumer may bring proceedings, at their choice, before the court of the place where they resided at the time of the Order or of the event giving rise to the damage.
